Prior to searching for homes, you must read and agree to the "Terms of use" governing this website. At the bottom of this page is a button for you to accept the terms. You are not required to enter any personal information,however, you must accept the terms to proceed.

These Terms of Use (the “Agreement) govern the use of rebatemyhome.com web site (the “Site”). By accepting the Terms of Use of “the Site”, you acknowledge this agreement.

  1. This agreement creates an agency relationship between you “the user” and Rebate My Home (www.rebatemyhome.com). This is a non-exclusive relationship until a purchase contract is written on your behalf with an agency relationship form fully executed or an exclusive right to represent you as a buyer has been fully executed.
  2. Before working with Rebate My Home (www.rebatemyhome.com) you should understand what responsibilities and duties Rebate My Home has to you as a broker. Rebate My Home will represent you as a buyer’s agent and perform the following responsibilities.
    1. Explain forms of Agency available in the state of California.
    2. Maintain utmost confidentiality regarding broker client relationship.
    3. Counseling regarding financial qualifications and offer unbiased professional advice regarding structure of transaction to meet your goals.
    4. Provide tools to locate homes that meet the criteria (beds, baths, square footage, lot size, location etc.) of the client.
    5. Maintain the highest level of ethics from beginning to end.
    6. Negotiate and prepare the purchase contract on your behalf based on your individual needs and requirements.
    7. Arrange and communicate time frame of inspections and facilitate the disclosure process (Full Service).
    8. Maintain close contact with Escrow, Title, and Mortgage Company to stay abreast for a timely close (Time is of the Essence).
    9. Utilize third party transaction coordinator as a courtesy service and additional set of professional eyes reviewing the transaction.
    10. Will review settlement statement (HUD 1) with buyer prior to closing.
    11. Negotiate on your behalf to achieve the ultimate goal.
    12. Be present for home showings after buyer has pre-screened homes that meet their criteria.
    13. Work directly for you (buyer) unless there is a dual agency relationship of which will be disclosed and communicated to you with pros and cons.
  3. Rebate My Home (www.rebatemyhome.com) is a California business, the website and rebate program pertains to residences offering a Selling Agent (buyer’s) commission in Riverside and San Diego County in the State of California.
  4. The site can be used to search homes without an agreement but before Rebate My Home (www.rebatemyhome.com) arranges home showings the buyer(s) will be required to enter into an Exclusive Right to Represent to be fully executed by both parties.
  5. The MLS and links provided list properties available for sale that may or may not be represented by Rebate My Home (www.rebatemyhome.com) as a Listing Agent and is not to be misconstrued as advertising for other Brokers. If the home is currently listed for sale and is represented Rebate My Home (www.rebatemyhome.com) a potential Dual Agency (Cooperating Broker Relationship) may occur of which will be disclosed to all parties.
  6. Dual Agency is when a Broker represents both buyer and seller in the same transaction and is legal in the State of California. A Broker has fiduciary relationship and must:
    1. Be honest and fair at all times.
    2. May not disclose whether a seller will accept an offer for less than asking price.
    3. May not disclose if a buyer would be willing to pay a higher price.
    4. Must keep confidential information CONFIDENTIAL unless specifically instructed in writing to disclose.
  7. Real Estate commissions are not set by law and can vary from property to property. Each Listing Broker (Seller) sets their own commission for the selling agent (Buyer). Rebate My Home does not change the rebate percentage (schedule) to the buyer based on commission to be paid to Selling Broker. The rebate structure (breakdown) is based on purchase price first then assigned the percentage of the total commission according to the schedule below.
  8. Rebate Schedule

    $450,001 - $550,000 45%
    $550,001+ 50%

    Example

    Purchase Price Commission Rebate % Total rebate to buyer
    $250,000 3% 40% $3,000
    $500,000 3% 45% $6,750
    $750,000 3% 50% $11,250

    Disclaimer:

    On a $250,000 home purchase with a 3% commission, the selling brokerage would receive a $7,500 commission but instead $3,000 of this figure would be applied as a credit to the buyer.  Example $250,000 X 3% = $7,500 x 40% = $3,000 rebate to buyer. On a $250,000 home purchase with a 2.5% commission, the selling brokerage would receive a $6,250 commission but instead $2,498 of this figure would be applied as a credit to the buyer.  Example $250,000 X 2.5% = $6,250 x 40% = $2,498 rebate to buyer.

  9. You the user agrees to indemnify and hold harmless Rebate My Home (www.rebatemyhome.com) from Real Estate Brokers who claim to have been the procuring cause of sale conducted through Rebate My Home (www.rebatemyhome.com).
  10. Any electronically produced message (email, fax, efax, website etc.) provided to you by Rebate My Home (www.rebatemyhome.com) are to be used by you the user solely. It is a violation of this agreement if any information is sold or distributed without proper authorization.
  11. Rebate My Home (www.rebatemyhome.com) site is on an as is basis without any expressed or implied warranty regarding content.
  12. Many of the links provided are not affiliated with Rebate My Home (www.rebatemyhome.com) and are provided as reference only to assist you in your home purchase.
  13. You indemnify and hold harmless Rebate My Home (www.rebatemyhome.com) for any damage, loss or claims whatsoever resulting from the use of our website or any linked site.
